These Terms and Conditions (United States) ("Terms") constitute a legally binding agreement between you ("Member," "you," or "your") and Eagle Federal Credit Union ("Eagle FCU," "we," "us," or "our"), Registration Number 15240581, governing your use of our website https://eaglefcu-onlineba.com and all financial products and services we provide.

By accessing our website, opening an account, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy. If you do not agree with these Terms, you must not use our services.

2. Eligibility and Membership

2.1 Membership Requirements

To become a member of Eagle Federal Credit Union and use our services, you must:

  • Be at least 18 years of age or the age of majority in your state of residence
  • Be a U.S. citizen or permanent resident with a valid Social Security number
  • Reside, work, or attend school within our field of membership
  • Meet our identity verification requirements
  • Purchase and maintain a minimum share in the credit union (typically $5)
  • Provide accurate and complete information during the application process

2.2 Account Opening

When you apply for membership or open an account, you represent and warrant that:

  • All information provided is accurate, current, and complete
  • You will maintain the accuracy of such information
  • You have legal capacity to enter into binding contracts
  • You are not prohibited from receiving services under U.S. laws
  • Your use of our services complies with all applicable laws and regulations

2.3 Account Approval

Eagle FCU reserves the right to approve or deny membership applications and account openings at our sole discretion. We may conduct background checks, credit checks, and identity verification as part of the approval process.

3. Account Management and Responsibilities

3.1 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials, including usernames, passwords, and PINs
  • Notifying us immediately of any unauthorized access or security breach
  • Ensuring that your contact information remains current
  • Reviewing account statements and reporting discrepancies within 60 days
  • Using secure internet connections when accessing online banking
  • Installing and maintaining up-to-date antivirus and security software

3.2 Authorized Users

If you authorize additional users on your account, you remain responsible for all transactions and activities conducted by those individuals. You agree to inform authorized users of these Terms and ensure their compliance.

3.3 Account Maintenance

You agree to:

  • Maintain sufficient funds to cover transactions and fees
  • Notify us of address, phone number, or email changes within 30 days
  • Review monthly statements and transaction history
  • Report errors, unauthorized transactions, or discrepancies promptly
  • Comply with all account-specific terms and conditions

4. Products and Services

4.1 Savings and Checking Accounts

Account terms, including minimum balance requirements, interest rates, and fees, are detailed in separate account agreements and fee schedules. Interest rates are variable and subject to change without notice unless otherwise specified in your account agreement.

4.2 Loans and Credit Products

All loans and credit products are subject to credit approval and specific loan agreements. By accepting a loan or credit product, you agree to:

  • Repay the principal amount plus applicable interest and fees
  • Make payments on or before scheduled due dates
  • Maintain adequate insurance on collateral when required
  • Provide accurate financial information
  • Notify us of material changes in your financial circumstances

4.3 Online and Mobile Banking

Our online and mobile banking services allow you to:

  • View account balances and transaction history
  • Transfer funds between accounts
  • Pay bills and schedule payments
  • Deposit checks remotely (mobile deposit)
  • Manage alerts and notifications

You must use compatible devices and internet connections. We are not responsible for issues arising from incompatible technology, service interruptions, or user error.

4.4 Debit and Credit Cards

Card usage is governed by separate cardholder agreements. You are liable for all authorized transactions and for unauthorized transactions if you fail to report lost or stolen cards promptly. Report lost or stolen cards immediately by calling +1 (478) 440-1650.

5. Fees and Charges

5.1 Fee Schedule

Our current fee schedule is available on our website and at our branch locations. Fees may apply for:

  • Monthly account maintenance
  • Overdrafts and insufficient funds
  • ATM usage (out-of-network)
  • Wire transfers
  • Stop payment orders
  • Account research and copies
  • Loan origination and closing costs
  • Returned check or payment fees

5.2 Fee Changes

We reserve the right to modify fees with at least 30 days' advance notice. Notice will be provided through monthly statements, email, website posting, or other reasonable means. Continued use of services after fee changes constitutes acceptance.

5.3 Overdraft Policy

If your account lacks sufficient funds to cover a transaction, we may, at our discretion:

  • Return the transaction unpaid and charge a fee
  • Pay the transaction and charge an overdraft fee
  • Transfer funds from a linked account (if enrolled in overdraft protection)

Overdraft protection services are subject to separate agreements and fees.

6. Transactions and Payments

6.1 Transaction Processing

Transactions are processed according to our standard procedures, which may involve:

  • Same-day processing for transactions received before cut-off times
  • Next business day processing for transactions received after cut-off times
  • Delays due to weekends, holidays, or verification requirements
  • Holds on deposited funds as permitted by federal regulations

6.2 Electronic Funds Transfers

Electronic funds transfers (EFTs), including ACH transactions, are governed by federal law and our EFT agreement. You have specific rights and responsibilities regarding EFTs, including the right to stop payment and the obligation to report errors within specified timeframes.

6.3 Bill Payment Service

Our bill payment service allows you to schedule payments to third parties. You are responsible for:

  • Ensuring accurate payee information
  • Scheduling payments with sufficient lead time
  • Maintaining adequate funds to cover scheduled payments
  • Canceling payments before processing deadlines

We are not liable for delays or failures caused by payee processing, incorrect information, or insufficient funds.

7. Disputes and Error Resolution

7.1 Reporting Errors

If you believe an error has occurred on your account, notify us immediately by:

Provide your name, account number, description of the error, and dollar amount involved. Written confirmation may be required for certain error types.

7.2 Investigation Timeline

We will investigate reported errors according to federal regulations, typically within:

  • 10 business days for most errors
  • 45 days for new accounts, point-of-sale transactions, or foreign-initiated transactions
  • 90 days for certain complex cases

We will notify you of investigation results and any corrections made to your account.

7.3 Provisional Credit

For certain error types, we may provide provisional credit to your account during the investigation period. If the investigation determines no error occurred, we may reverse the provisional credit.

8. Account Closure and Termination

8.1 Voluntary Closure

You may close your account at any time by:

  • Visiting a branch location with valid identification
  • Submitting a written closure request
  • Calling our member services department

You are responsible for outstanding balances, fees, and scheduled transactions before closure is finalized.

8.2 Involuntary Closure

Eagle FCU reserves the right to close accounts, suspend services, or terminate membership if:

  • Account remains inactive for an extended period
  • Negative balance persists despite collection efforts
  • You violate these Terms or other agreements
  • We detect fraudulent or illegal activity
  • Your conduct threatens the safety of staff or other members
  • We are required to do so by law or regulatory order

8.3 Final Settlement

Upon account closure, you must:

  • Return all credit union property (cards, checks, access devices)
  • Pay outstanding balances, fees, and charges
  • Cancel automatic payments and deposits linked to the account

Remaining funds will be disbursed according to your instructions or by check mailed to the address on file.

9. Liability and Disclaimers

9.1 Limitation of Liability

To the fullest extent permitted by law, Eagle Federal Credit Union's liability is limited to direct damages only. We are not liable for:

  • Indirect, incidental, consequential, or punitive damages
  • Lost profits or business opportunities
  • Service interruptions or system failures beyond our control
  • Third-party actions or omissions
  • Your failure to comply with security procedures
  • Unauthorized access resulting from your negligence

9.2 Force Majeure

We are not responsible for delays or failures in performance resulting from causes beyond our reasonable control, including:

  • Natural disasters, pandemics, or public health emergencies
  • War, terrorism, or civil unrest
  • Government actions or legal restrictions
  • Internet or telecommunications failures
  • Power outages or equipment malfunctions
  • Labor disputes or strikes

9.3 Website Availability

While we strive to maintain continuous website availability, we do not guarantee uninterrupted access. We may suspend or restrict access for maintenance, security updates, or other operational reasons. We are not liable for losses resulting from website downtime or unavailability.

9.4 Information Accuracy

We make reasonable efforts to ensure information on our website is accurate and current. However, information may contain errors, omissions, or become outdated. We reserve the right to correct errors and update information without notice. Always verify important information with a member services representative.

10. Intellectual Property

10.1 Ownership

All content on our website, including text, graphics, logos, images, software, and design elements, is the property of Eagle Federal Credit Union or our licensors and is protected by copyright, trademark, and other intellectual property laws.

10.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes. You may not:

  • Reproduce, distribute, or publicly display website content
  • Modify, reverse engineer, or create derivative works
  • Use automated systems to access or extract data (scraping)
  • Remove copyright or proprietary notices
  • Use our trademarks or branding without permission

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by the laws of the State of Hawaii and applicable federal laws, without regard to conflict of law principles.

11.2 Arbitration Agreement

Any dispute, claim, or controversy arising from these Terms or our services shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration will take place in Hawaii, and judgment on the arbitration award may be entered in any court having jurisdiction.

11.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions, class arbitrations, or representative proceedings.

11.4 Exceptions

Either party may seek injunctive or equitable relief in court to protect intellectual property rights or prevent unauthorized account access.

12. General Provisions

12.1 Amendments

Eagle FCU reserves the right to modify these Terms at any time. Material changes will be communicated through website posting, email notification, or account statements. Continued use of services after changes take effect constitutes acceptance of modified Terms.

12.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

12.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

12.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign our rights and obligations to any successor organization or third party.

12.5 Entire Agreement

These Terms, together with our Privacy Policy and product-specific agreements, constitute the entire agreement between you and Eagle Federal Credit Union regarding the use of our services.
